One license office, not two
Germantown is unincorporated, so unlike Rockville and Gaithersburg there is no city rental program here. A single-family or townhouse rental needs one annual license from the county Department of Housing and Community Affairs, with a license year running July 1 through June 30 and renewal due by July 31, and the fee is not prorated if you only rented part of the year. Since July 23, 2024 the county caps annual rent increases at the local CPI-U plus three percent, six percent at most, and exempts landlords who rent out two or fewer units, which describes most of the owners who call us from Germantown.
Since October 1, 2024, a tenant who has lived in a one to three unit rental for at least six months on a written lease gets a 30 day window under Maryland law to make an offer before you accept an outside one. That state rule replaced the older Montgomery County right of first refusal the county housing office administered for these small sales, and it does not apply to an estate selling an inherited rental. The association packet and the radon test
- Condo resale certificate. Section 11-135 of the Maryland Real Property Article. The association has to produce it, and a retail contingency cannot start until it does. We sign first and order it ourselves.
- HOA disclosures. Section 11B-106 for the townhouse and single-family associations. Unpaid dues, a special assessment or an open violation are settled from the proceeds at closing.
- Radon. A townhouse is a single-family home under the county rule, so a test less than a year old has to be shared before settlement. We order and pay for it. Garden condos are exempt.
- Utility bills. Twelve months of electric and gas bills go to the buyer. If the house sat empty, you provide what exists.
Closing costs, probate and the June date
Recordation tax is $4.45 per $500 on the first $500,000 and steps up above that, the county transfer tax is 1% and the state adds 0.5%, all calculated by a licensed Maryland title company and paid from closing funds. If the house is part of an estate, the Register of Wills at 50 Maryland Avenue in Rockville opens it and the personal representative’s account is due within nine months of appointment; we buy mid-probate with the contents in place. If county taxes are behind, the lien goes to the sealed-bid sale on the second Monday in June, and a cash closing before that date pays the county from your proceeds.
