Maryland
Do I need a realtor to sell my house in Maryland?
No. Maryland does not require a real estate agent to sell a house. You need a signed contract, the Maryland Residential Property Disclosure and Disclaimer Statement, and a licensed Maryland title company to handle settlement. You can list with an agent, use a flat fee MLS listing, sell it yourself, or sell to a cash buyer.
The short version
- The disclosure and disclaimer statement under Real Property § 10-702 is required in every sale, agent or not. Even with the disclaimer, known latent defects must be disclosed.
- A listing agent usually costs 5 to 6 percent of the price. A flat fee MLS listing costs a few hundred dollars up front and leaves the showings, negotiation and paperwork to you.
- Selling to a cash buyer is the no agent route that still comes with professional settlement: the buyer brings the contract, a licensed Maryland title company runs closing, and there is no commission on either side.
- Our principals are licensed Maryland agents buying for their own account. When a listing would net you more, we say so.
What a sale without an agent still needs
- A written contract. Ours comes with every disclosure Maryland law requires, including the 2025 wholesale assignment notice.
- The disclosure and disclaimer statement, filled out honestly.
- A title search and settlement through a licensed Maryland title company, which also pays the transfer and recordation tax from the proceeds.
- If the house is an estate, letters of administration from the Register of Wills so the personal representative can sign.
Which route fits
- Retail condition, time to wait. List it, with an agent or a flat fee. Top price.
- Needs work, or the date matters. A cash buyer. The trade is 10 to 25 percent under fixed up value for a sale that costs nothing and closes when you say.
- Not sure. Get a listing estimate and a written cash offer and compare the net. Should I accept a cash offer on my Maryland house walks through it.

Maryland seller questions
- Do I need a lawyer to sell a house in Maryland?
- No. Maryland closings run through title companies, not attorneys. An attorney review of the contract is optional and sensible on an estate or divorce sale.
- Can I sell my house as-is in Maryland without an agent?
- Yes. As-is means no repairs, not no disclosure. You still complete the disclosure and disclaimer statement, and a cash buyer takes the house as it stands.
- How long does it take to sell a house for cash in Maryland?
- A written offer usually within a day and settlement in two to three weeks on a house with clean title, against roughly two to three months for a listed and financed sale.
